MyServiceAuction Provider Agreement

This Provider Agreement (“Agreement”) governs your access to and use of the MyServiceAuction platform (“Platform”) as a service provider (“Provider”, “you”).

By registering as a Provider, you agree to the terms below.

1. Platform Role

MyServiceAuction is a marketplace that connects customers with independent service providers.

MyServiceAuction:

  • Does NOT provide services directly
  • Does NOT employ Providers
  • Does NOT guarantee job volume or earnings

You acknowledge that you operate independently and are solely responsible for the services you provide.

2. Independent Contractor Status

You are an independent contractor and not an employee, partner, or agent of MyServiceAuction.

You are responsible for:

  • Your own taxes
  • Licenses, permits, and certifications
  • Insurance (where applicable)
  • Compliance with local laws and regulations

3. Service Responsibility

You agree that:

  • You are fully responsible for the quality, safety, and legality of your services
  • You will provide accurate bids and honor accepted jobs
  • You will communicate professionally with customers

MyServiceAuction is not responsible for:

  • Work performed
  • Damages caused
  • Service outcomes

4. Payments & Fees

MyServiceAuction may facilitate payments between customers and Providers.

You agree that:

  • The Platform may charge a percentage-based service fee per transaction
  • Fees may be deducted automatically before payout
  • Payment timing may vary depending on job status, disputes, or platform policies

You acknowledge that:

  • Some payments may occur through the Platform wallet
  • Some payments may occur directly between you and the customer

MyServiceAuction is not liable for:

  • Payment disputes outside the Platform
  • Non-payment in off-platform transactions

5. Ratings & Reputation

Your performance may be evaluated through:

  • Ratings
  • Reviews
  • Tags or feedback

You agree that:

  • Ratings impact your visibility and eligibility on the Platform
  • MyServiceAuction may adjust, reset, or moderate ratings at its discretion
  • Abuse, manipulation, or fraudulent activity may result in penalties

6. Cancellations & Reliability

You agree to:

  • Fulfill accepted jobs unless reasonably unable to do so
  • Avoid excessive cancellations

Repeated cancellations or no-shows may result in:

  • Reduced visibility
  • Account suspension or removal

7. Disputes

MyServiceAuction may assist in resolving disputes between Providers and customers.

You agree that:

  • The Platform has the right to review disputes
  • The Platform may make final decisions regarding outcomes
  • Decisions may include adjustments to payments, ratings, or account status

8. Account Suspension & Termination

MyServiceAuction may suspend or terminate your account at any time for:

  • Violation of this Agreement
  • Fraudulent, abusive, or unsafe behavior
  • Poor performance or repeated complaints

You may also stop using the Platform at any time.

9. Limitation of Liability

To the maximum extent permitted by law:

MyServiceAuction is not liable for:

  • Any damages, losses, or claims arising from services provided
  • Customer interactions
  • Platform interruptions or errors

Your use of the Platform is at your own risk.

10. Indemnification

You agree to indemnify and hold harmless MyServiceAuction from any claims, damages, or liabilities arising from:

  • Your services
  • Your conduct
  • Your violation of laws or this Agreement

11. Modifications

MyServiceAuction may update this Agreement at any time.

Continued use of the Platform constitutes acceptance of any updates.

12. Governing Law

This Agreement is governed by applicable laws in Canada and, where applicable, the United States, depending on the location of services provided.

13. Acceptance

By registering and using the Platform as a Provider, you confirm that you have read, understood, and agreed to this Agreement.
